How to evict tenants
When a landlord decides to go in for tenant eviction, he first needs to mention the exact cause/causes clearly in the legal eviction notice he sends to his errant tenant. Causes can range from rent arrears, breach of tenancy clause, and damage to property or indulging in illegal activities or offensive behavior.
Next he has to keep his paperwork ready and up to date and in order so that this paperwork can serve as concrete evidence in the court later on. By paperwork I mean evidence of non payment of dues, tenant’s original rental application, original tenancy contract and evidence of breach etc.
The suffering landlord should take legal advice at every step right from the very beginning and hire an experienced attorney who will handle his tricky legal hassles for him, keep the paperwork in order, serve legal notices, and file court case if necessary.
Before the tenant moves out you need to check your premises to ascertain the extent of damage to property and take photographical evidence of the same and include them in your records. But inspection of premises should be preceded by a twenty four hour notice.
The eviction notice has to be slapped properly, taking care to file the complaint in the correct legal manner and following the necessary legal sequence or order of events.
